Motor carriers and private fleets are easy targets for audits and lawsuits challenging whether an owner-operator is an employee or an independent contractor, potentially subjecting you to significant penalties if the owner-operator is determined to be an employee.
This webinar will provide an overview of the applicable tests used to determine whether a worker is an employee or an independent contractor. Our presenters will also discuss the regulations applicable to owner-operator lease agreements and give practical pointers for effectively contracting and interacting with owner-operators in daily operations to help avoid coming out on the wrong side of the employee vs. independent contractor analysis.
About the Presenters:
Andrew Stephenson, Esq.:
As a senior principal with Franklin & Prokopik, Andrew Stephenson is a seasoned civil litigator, with a primary focus on defending companies against civil suits involving catastrophic losses. Mr. Stephenson also defends corporations and individuals in civil matters involving construction, commercial transportation, intentional torts, premises and products liability. He is currently a member in good standing of the New York and Maryland State Bar Associations and serves as an adjunct professor at the University of Baltimore Law School.
Mr. Stephenson is a member of the board of directors for the Trucking Industry Defense Association; a member of the National Restaurant and Retail Defense Association; a fellow of the American Bar Foundation; a member of the American College of Transportation Attorneys (ACTA); the former Chair of the ABA’s Commercial Transportation Litigation Committee; the Co-Chair of the ABA’s Transportation Megaconference. He also routinely attends and participates in the Arkansas Trucking Seminar, Defense Research Institute Trucking Seminar and he is an active member of USLAW. Mr. Stephenson serves as General Counsel to the Maryland Motor Truck Association; the Maryland Movers’ Council; and the Maryland Motor Coach Association.
Renee Bowen, Esq.:
As counsel with Franklin & Prokopik, Renee Bowen focuses her practice on civil liability defense with an emphasis on trucking and transportation law. She also represents clients in general liability defense matters in the areas of motor torts, premises liability, products liability, employment law, construction litigation, insurance coverage, commercial litigation, and landlord/tenant disputes. In addition to her active litigation practice, Ms. Bowen prepares a wide range of transportation contracts for clients nationwide, including transportation services agreements, owner-operator agreements, equipment leases, broker/carrier agreements, shipper/carrier agreements, and shipper/broker agreements. Ms. Bowen also assists clients with issues related to regulatory compliance.
Ms. Bowen serves as General Counsel for the Maryland Motor Truck Association’s Intermodal Council and for the Maryland Motor Coach Association. She also serves as co-editor of Franklin & Prokopik’s Transportation Dispatch Newsletter. Ms. Bowen is a member of the Maryland State Bar Association and is admitted to practice law in the State of Maryland and the United States District Court for the District of Maryland.
