This webinar is part of the ATA Litigation Center's Wheels & Deals: Mastering the Art of Negotiation Training Series.

Bracketing

Webinar Description:

Bracketing is a helpful technique for preventing and breaking impasse in your mediations. Also referred to as contingent offers and demands, or sometimes as the “Texas Two Step,” bracketing involves an offer or demand in the form of a proposed range rather than a binding numeric offer or demand. Those who are less familiar with this technique may resist using it to their detriment. There is art and science to effectively using bracketing that can be taught and mastered. When used strategically, bracketing is a powerful tool. This webinar will share practical advice for understanding how and when to effectively use bracketing as a technique for avoiding impasse and arriving at better deals.
