As many motor carriers have experienced, working with independent contractors and managing telematic tools like electronic logging devices (ELDs) presents many challenges. This webinar will guide motor carriers in the implementation of telematics and other safety-related devices in an independent contractor fleet. Topics that will be covered include:
- What to do when the mandated use of telematic and safety related devices run afoul of the federal leasing regulations
- What control a motor carrier may assert while still avoiding misclassification claims
- How safety incentives may be utilized to encourage adoption
Additionally, efforts to enact legislation that protect Independent Contractor status while encouraging adoption of safety-related devices will be reviewed and discussed.

About the Presenters:
Kelli M. Block, Partner, Scopelitis, Garvin, Light, Hanson & Feary
Ms. Block's practice is devoted to serving clients on a wide variety of legal issues, with a concentration on independent contractor issues directly facing the transportation industry. Ms. Block focuses her practice on the representation of transportation carriers, freight-forwarders, and logistics companies in regulatory compliance, transportation contract review, owner-operator leasing arrangements, insurance disputes, and IRS matters. Ms. Block also counsels clients on insurance program development and alternative risk programs.
Shannon M. Cohen, Partner, Scopelitis, Garvin, Light, Hanson, & Feary
Ms. Cohen provides legislative counsel services to the firm's clients. Ms. Cohen monitors forthcoming and active legislation and regulation pertaining to issues affecting motor carrier, with an emphasis on legislation touching on the independent contractor status of owner-operators using her extensive background with and familiarity of owner-operator programs and issues attendant to the design of successful owner-operator model. She regularly assists in drafting and revising legislation and assessing and communicating the impact of such legislation on the trucking industry.
Prasad Sharma, Partner, Scopelitis, Garvin, Light, Hanson & Feary
Mr. Sharma focuses his practice on advocacy before state and federal legislative and regulatory bodies and advises on a wide array of regulatory compliance issues. He leads from the firm's Washington D.C office on legislation support initiatives and provides a legal liaison function to firm clients seeking transportation and logistics industry national and state association outreach and issue-specific coordination of desired legislative outcomes. Prior to joining Scopelitis, Mr. Sharma spent fifteen years as in-house counsel at ATA, where he spent the last four years as senior vice president and general counsel, as well as executive vice president and general counsel to the ATA Litigation Center.
